A Woman in Florida has filed a five million dollar class action lawsuit against confectionary giant Hershey over false advertising. The product in question? Reese’s Peanut Butter Cup Pumpkins. What’s the issue? On the packaging, it shows the pumpkin-shaped chocolate/peanut butter delight sporting a jack-o-lantern face but to the horror of Cynthea Kelly, the woman filing this lawsuit, it was just a pumpkin-shaped chocolate peanut butter cup!
Cynthea is not alone as others on social media and YouTubers have had their Halloween experience ruined by the pumpkin-shaped candy not having a jack-o-lantern face carved out of it. Companies have the right to creatively advertise a product or to make it fit the season. True, some companies have indeed lied about products and they have been rightly called out on it, then there are cases like this where it seems to be a bit of a stretch and showing an increasing problem I’ve been noticing socially… feigned inconvenience, where people either being a customer or just out and about are mad or upset at something that’s not hurting them. But if you would prefer a saying that sounds like it came from the mouth of a nice little old person sitting on their front porch, “Some people are not happy unless they’re upset about something.”.
At this time, it’s unsure if this lawsuit will even gain traction in court, but we’ll have to see.
